    #36 Another demonstration of your ignorance. Your remarks confuse trademark infringement with patent infringement. When it comes to trademarks, the U.S. law provides that the ownership of the trademark goes to the first to use it sufficiently to establish its inextricable connection with a product, whether goods or services -- independent even of who first "registered" the trademark, really their "claim" to the trademark. That is why an initial trademark search is called a "knockout" search and why, if the initial search shows that a trademark has been previously registered, it is necessary to then do a "complete" or advanced search to discover whether the trademark has actually been used sufficiently to defend the nominal registration of it.

    For the record, the "TM" mark indicates that a claim to the trademark is being asserted. The (r) and (reg) marks are what indicates that a trademark has been registered -- although, as mentioned, even registering a trademark does not confer final ownership, which is often withheld for five or more years. And BTW, if you fail effectively to continuously use a trademark the ownership of which you have legally established, you lose the ownership of that trademark.

    Beyond that, even in the case of sustaining a judgment of trademark infringement, there always remains the question of actual damages. If one infringed on the "Kleenex" brand trademark and sold millions of dollars of tissues under that trademark, serious damages could be involved. But in many cases, the verifiable damages are so little, it is hard to get a lawyer to take the case. Feel free to peddle your B.S. elsewhere.

    Where do you get your expertise, from "The Complete Idiot's Guide to Consulting"? A book that apparently from its title trains complete idiots to be consultants?

    No, your remarks reflect not only total ignorance of yachting and the yacht market and industry but of the people who buy luxury items like that. For otherwise, you might know that in general, they do not accumulate the wherewithal to spend the money that they do by worrying or caring about where a website is hosted. Eventually, of course, buyers want to visit one's place of business and in the case of yacht building, one's shipyard. But that is very different than being impressed by, of all things, how a website is hosted. I am not defensive. I am annoyed at the level of your ignorance and unsupported self-ascribed importance.

However, it's also important to know that, under U.S. law, even when a trademark is "registered" there is a requirement to demonstrate that it has actually been used for several years, in order to defend the validity of that registration. Also that conflict between "styled" trademarks may only hold up if the goods or services respectively identified in commerce by the trademark are sufficiently similar to cause confusion.

    However, to my mind, that is all a tempest in a teapot, of little interest to most people because a trademark is just that, an identifying mark used in the course of trade. It is not a patent or a copyright and does not protect the design(s) or concept(s) involved. (continued pt.II)

    #27 Franci - Pt. II -- Regarding crowdfunding (not to be confused with crowdsourcing) -- or for that matter, any form of investment -- experienced investors do not bet on product names alone. True some names are catchier than others, but when push comes to shove, the core product concept is what carries the day, as well as the all of the other ingredients that go into building a company to produce and sell the goods or services involved.

    In this case, the capital funding required is in seven figures, so the potential investors, of which a number are already lined up, are not going to be scared off by some self-styled "expert" on social media. As well, because the start-up capital requirement is substantial, we' are seeking to tap into several different funding sources, including, as I mentioned to Brian McKenzie, giving the first 40 customers a 1% equity share in the company.

    As always, I appreciate your and everyone else's kind support on this. It certainly helps get the word out. Which is one reason why the news release is being published on beBee and LinkedIn before being distributed to the yachting and marine industry press.

    Brilliant idea, Phil. Seems if there was an issue with the TM, the state of FL would have informed you at the time you registered. I had a TM quite some time ago and there was a search done, which the results were furnished with instructions as to whether or not the TM was clear.

I've also learned that there is huge IP significance in the exact styling of hyphens. I'll store that away for future reference.     I salute you Donna-Luisa. As a child, my grandmother spoke German. My mother and I still share a few phrases. I learned enough Korean to make friends in that language when I returned to the USA. I used my High-school French in Paris for a few weeks and found the gratitude for the attempt overwhelming. I will continue to learn more of Spanish and French as well as the language wherever I find myself in the world. I choose to know.

    Always learning and always willing to learn. Just one of the great things that I love about you, @Donna-Luisa Eversley. A couple of years ago I visited a vendor partner in Germany. I was there for meetings and an educational summit. There were attendees from many countries and I particularly loved being immersed in the different languages. I took three years of Latin in high school (many moons ago) and a year of Spanish in both high school and college. I know bits and pieces of German and Czech from working with our partners there but would love to really learn the languages. Kudos to you for climbing the wall.

    I concur with your comment dear @DILMA BALBI -📃 Engenharia&gestão. Just before reading your comment I was reading comments on few of my buzzes just to see how comments apppeal to me. Few comments grabbed my attention even much stronger than before. I felt the attraction to them and my self identity changing. These are not passing thoughts, but more of rooted ideas now.
    BTW_ it is extremely rewarding to go back and read some of your comments on different buzzes. It is amazing how new ideas emerge. I wonder if dear Sara @Sara Jacobovici has tried it as well, but like old roots giving life again so is re-reading your comments.

    wow... how many aspects to think we get after reading this buzz.. I "feel" that thoughts are previous than ideas.. and as someone here said before,, we are not then.. Thoughts came and go every single moment "inside" our heads... But we are not then...And when one thought shines than other ones we ""go" with this though and... we "develop" the thought and ... we call then ... ideas...     @Ali 🐝 Anani, Brand Ambassador @beBee Ideas are energy created within a network of energy. I agree that we should look at ideas as tangible even though they reside within an energy field. Nature is efficient. The shapes and designs serve to conserve energy in executing life.

    Like nature our ideas should seek to do the same thing. Ideas should include a efficient design. The more energy we have to use to either build or maintain an idea will determine its success.

    Using the ball analogy we can see that the ball is 360 degrees. Energy needs to increase the further I move from my perspective. Say I am at 180 degrees with an idea, I can form influence in a diameter of 20 degrees. Once I move past this the energy required grows exponentially. Like the lioness summing up its prey, it has to choose where energy can best be focused.

    I introduce this because an idea is a random photon unless we add energy. Like photons, ideas abound but as a species we have to choose what and where we will place energy.

    Nature lacks consciousness so efficientcy is its only focus. Our species has consciousness which allows us to (good or bad) discern. This discernment is leveraged on our perceptions and mainly our fears. The energy of an idea can be foreshadowed by our perceptions.

    A stack of 2x4's is merely lumber until a carpenter applies energy to build a house. Ideas are similar to the 2x4's merely lumber until energy is applied.

    This gets into a larger discussion about influence vs control. That is for another day.

For me it forms the triad; myself, my vision, my customer. If I hold a clear vision of what I/my company is all about, I am then able to "see" the need/dark side of my customer/marketplace and fulfill that need in the most successful means possible. This results in my customer/marketplace being illuminated and in this way spreading my vision for all to "see" and be drawn towards it. I wonder, Dr. Ali, if this is a potential subset in the formula to success?

Spherical bubbles get this shape because it is the shape of least energy requirement by having the least surface area. Now, I think because of your comment and Sara's comment their is a hidden reason- to not see the whole ball and that we must be illuminated from within us, be ready to rotate the ball (bubble), look at different perspectives, imagine and listen to other peoples' vies. It ball shape is the test if we can do that. So, I love what you wrote dear Mohammed "ideas are the lights of our paths and our journey ,so we should stay plugged in,change our batteries to turn on our light in the dark side of the marketplace".

    @The perversity of nature is clearly demonstrated by the fact that ,when exposed to the same atmosphere bread becomes hard ,Exactly the same; ideas become hard and empty if they are not enrolled or balled like 'day and night',and turned to concepts and solutions.Implementing ideas is at least as important as generating them and when ideas are first propounded by outdated beliefs without referring to formal studies ,the pipelines of our thoughts will get dry.We are always faced with the dark side of the ball,faced with many dark areas and blind spots in the marketplace which are considered barriers to our innovation or wrong perceptions when creative ideas are killed in their generation stage .The more outdated beliefs are held in our minds ,the more darker areas you create in your customers mind and the more barriers to your innovation you will encounter.Our ideas are the lights of our paths and our journey ,so we should stay plugged in,change our batteries to turn on our light in the dark side of the marketplace.The light inside us and the vision we created for our companies should be targeted toward the darker spots in customers mind.     An ordinary person inspired by the architecture of a 400 year old monument captured the monument detail with a small notes to look into adding detailing to thoughts within.
    Started workout at crawling pace collecting remains chipped wood and was motivated to accomplish.
