The Specialist Legal Marketing will act as the primary legal adviser to the Coal Marketing business and provide legal advice on a wide range of Coal Marketing issues, including in relation to:
Drafting, negotiation, execution and performance of [physical and derivative] Coal sales contracts for export and domestic sales;
Defaults and disputes under Coal sales contracts;
BHP Billiton’s role as a shareholder and market member in Coal trading platforms;
Trade finance instruments for Coal sales;
Shipping and logistics for Coal sales;
The relationship and interaction between the Coal Assets and Coal Marketing; and
Regulatory issues affecting Coal Marketing.
Identify legal risks affecting Coal Marketing, participate in risk assessments and advise on the management of those risks
Establish and maintain relationships with Coal Marketing stakeholders and act as a key point of contact for all legal issues
Support the Disputes Legal team in their management of major Coal Marketing disputes by providing business specific legal advice
Participate in and deliver on External Affairs, Legal and Business projects as required
Contribute to regular reporting to various Marketing and External Affairs stakeholders
Ensure effective engagement with other External Affairs teams, including the Coal Asset Legal team, the Disputes Legal team and the Compliance team
Deliver relevant training to identified Marketing individuals and contribute to the development of training material
Ensure cost effective and timely delivery of fit for purpose external legal services as required
Travel internationally as required
Minimum of five (5) years PQE experience in a well-regarded law firm or in-house legal team.Specialized Experience: Previous resources experience, including commodity marketing, having advised on issues associated with the global marketing of Coal. Experience in drafting and negotiating commodity sale and purchase agreements, confidentiality agreements, joint venture arrangements and other complex agreements. Understanding of the global legal and regulatory framework (including international trade laws such as sanctions) and developments applicable to the domestic and global sale and trading of commodities.
Education: Law degree.
License: Entitled to practice in a major common law jurisdiction such as Australia, Singapore or England.
